RANDY J. COX was raised on a cattle ranch on the Smith River
in west-central Montana and graduated from Cascade High School
and Montana State University. A 1979 graduate of Northeastern
University School of Law in Boston, Randy returned to Montana
and served two years as law clerk to Senior U.S. District Judge
W. D. Murray in Butte, Montana. In the fall of 1981, he joined
this firm, then known as Boone, Karlberg & Haddon. Since that
time, Randy has developed a statewide litigation practice
focusing on defense of claims relating to toxic exposure,
product liability, professional negligence, complex commercial
litigation and railroad litigation. Randy has briefed and argued
dozens of cases in the Montana Supreme Court and the U.S. Court
of Appeals for the Ninth Circuit.
Randy holds an “AV” rating in the Martindale-Hubbell Law
Directory, is a member of the American Board of Trial Advocates,
is listed in Best Lawyers in America, in Mountain States Super
Lawyers, in Chambers USA and in the Benchmark Litigation Guide titled
"America's Leading Litigation Firms and Attorneys". In 2001,
Randy and co-counsel, David Potter of Minneapolis, obtained a
defense verdict in a toxic tort lawsuit arising from the
derailment of a freight train in western Montana. The National
Law Journal selected that verdict as one of the top 20 defense
wins of the year. The litigation arising from that disaster,
which resulted in a major chlorine release and evacuation of the
town of Alberton for 19 days, occupied much of Randy’s
professional attention for several years and provided invaluable
experience related to mass disasters, class actions, toxic
exposures and the management of high-stakes litigation. The
derailment triggered nearly a hundred lawsuits and more than
2,000 claims. Three cases were successfully tried to
verdict before all remaining cases eventually settled.
In addition to his litigation practice, Randy has served as
President of the Montana Defense Trial Lawyers (1990-91), as
member and now Chair of the Montana Board of Bar Examiners
(1988-present, chair since 2001) and as member of the Supreme
Court Advisory Commission on Rules of Civil and Appellate
Procedure (1993-present). Randy was principal draftsman of the
local rules of the Fourth Judicial District Court. Randy has
been an adjunct professor at the University of Montana Law
School, teaching Article 2 of the Uniform Commercial Code
(1985-87) and Remedies (1990). He regularly guest lectures on
trial practice topics. Randy is the co-author of a law review
article on emotional distress claims (53 Mont. L. Rev. 197
(1992)) and has given presentations at more than 50 continuing
legal education programs across Montana, the western states and
Canada. He also serves on the faculty at the Advanced
Trial Advocacy program held each year at the University of
Montana Law School.
Contributing author, Montana section, "Use of Toxicology in Tort
Litigation", ABA Monograph, Products Liability Committee (2005)
(published electronically).
Randy and his wife, Theresa, have raised their sons, Jason and
Jamie, and daughter, Jessica, in Missoula. They both are
actively involved in the Missoula community, particularly in the
development and ongoing operation of A Carousel for Missoula,
one of the first fully hand-carved carousels built in the United
States since the Great Depression. The Carousel and the
adjoining Dragon Hollow Playground are marvelous additions to
the community. Randy and Theresa are very proud of both. If you
are in Missoula, please stop and enjoy. Randy’s other passions
are wine and tennis. He plays competitively in tournaments
around and outside Montana and enjoys collection and consumption
of fine wines.
